Trump hit with another court block in bid to deploy troops to Portland

The U.S. Court of Appeals for the Ninth Circuit has temporarily paused a ruling from a split three-judge panel that would have allowed President Donald Trump to call up the National Guard in Portland, Oregon, in response to protests at the city’s Immigration and Customs Enforcement (ICE) facility.

This pause means that, for the time being, President Trump remains blocked from deploying the National Guard in Portland.

According to Law Dork’s Chris Geidner, a resolution on en banc consideration is expected by 5 p.m. Tuesday. This would mean that the appellate court will decide whether to rehear the case before all judges on the court, rather than the initial three-judge panel, which was dominated by two of Trump’s appointees.

The Ninth Circuit as a whole has a majority of Democratic appointees and is often skeptical of Trump’s policies in legal challenges.

Previously, President Trump was blocked from the deployment by U.S. District Judge Karin Immergut, herself a Trump appointee. In a strong ruling, Judge Immergut found that none of the facts on the ground supported Trump’s claim that a rebellion was underway in Portland.
